Who we are

Mercurial LLC is a limited liability company organized in New Mexico. It operates the Mercurial Films brand and mercurialfilms.com. This policy explains how we handle information through the public website. It does not apply to third-party websites that we link to.

Questions and privacy requests may be sent to privacy@mercurialfilms.com.

What we collect

  • Contact form and email: your name, email address, subject, message, and any other information you choose to include. Contact form submissions are delivered to our email inbox.
  • Newsletter: your email address, the page or signup source you used, and a record of when you confirmed your subscription and which consent language applied. We use double opt-in, so you are not added to the newsletter until you confirm through the email we send you.
  • Site activity: pages viewed, referring pages, approximate region, browser and device information, operating system, and site performance measurements. Analytics events are recorded against a random identifier for your browser, or, once you sign in or confirm a newsletter subscription, against your account, in which case your email address is stored with our analytics provider. Events never contain your name or payment details.
  • Technical information: our hosting and security providers may process IP addresses, request data, and server logs to deliver the site, prevent abuse, and troubleshoot problems. We also use IP addresses temporarily to limit repeated form submissions.
  • Embedded video: when you choose to open a trailer, the video hosting provider may receive technical information about your browser, device, network connection, and interaction with the player.

Please do not send sensitive personal information through the contact form.

How we use information

We use the information described above to:

  • respond to messages and inquiries;
  • confirm newsletter subscriptions, send requested updates, and maintain unsubscribe records;
  • operate, secure, and troubleshoot the website;
  • understand general site use and improve the site's content and performance; and
  • comply with legal obligations and protect the website and its users.

Sending a message through the contact form does not subscribe you to the newsletter.

Cookies and similar technologies

We use a product analytics service, PostHog, to understand how the site and the Screening Room are used: which pages are viewed, which of our own links brought a visitor, and whether a visit led to a newsletter signup or a ticket. It sets a first-party cookie, named ph_ followed by a project identifier, holding a random identifier for your browser. Automatic capture of clicks and typing is turned off and sessions are not recorded. We do not use cookies for advertising or cross-site behavioral tracking.

When you arrive through one of our own short links, such as the link in our Instagram profile or a link in our newsletter, the site sets a first-party cookie named mf_ref for thirty days. It records only which of our links you followed and when, so we can tell which of our own channels a signup or a ticket came from. It contains no personal information, is never shared, and blocking it does not affect the site.

Embedded video players load only after you choose to open a trailer. We use the video provider's Do Not Track setting, but the provider may still set cookies that it considers necessary for security and operation of the player. You can control cookies through your browser settings, although blocking them may affect video playback.

Our analytics honors the browser Do Not Track and Global Privacy Control signals: when either is set, no analytics events are sent. We do not use personal information for cross-site behavioral advertising.

Services we rely on

We use service providers that support the following functions:

  • website hosting, content delivery, and security;
  • traffic and product analytics (PostHog, hosted in the United States) and performance measurement;
  • contact form delivery, newsletter delivery, and subscriber list management; and
  • embedded video playback when you choose to open a trailer.

These providers may process information as needed to provide their services and under their own privacy terms. We may also disclose information when required by law or when reasonably necessary to protect our rights, the website, or its users.

What we do not do

We do not sell or rent personal information. We do not share personal information with advertisers or use it for targeted advertising. We do not add contact form submissions or other business contacts to the newsletter without a separate subscription. The public website does not currently offer user accounts or accept payments.

Retention and security

We keep newsletter information while you remain subscribed. If you unsubscribe, we may keep a limited suppression record so that we do not add the address back to the list by mistake. Contact messages are kept for as long as reasonably needed to respond, maintain appropriate records, and resolve related issues. Technical and analytics information is retained under the settings and retention periods of the service providers described above.

We use reasonable administrative and technical measures to protect the information we handle. No method of storage or transmission is completely secure, so we cannot guarantee absolute security.

Your choices

You can unsubscribe from newsletter emails by using the unsubscribe method included in those messages. You may also email privacy@mercurialfilms.com to ask what personal information we hold about you or to request a correction or deletion. We may need to verify your identity before completing a request. We may retain limited information when required by law or reasonably necessary for security, recordkeeping, or honoring an unsubscribe request.

Children's privacy

The website is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information through the site, contact us and we will review the request.

Changes

We may update this policy when the website or our practices change. The effective date at the top of the page will be updated when we make changes. The current version will remain available on this page.
